Extrasele din registre \u0219i cadastru sunt valabile timp de 3 luni de la data ob\u021binerii lor. <\/p>\n\n<h3 class=\"wp-block-heading\">Alegerea notarului<\/h3>\n\n<p>Autentificarea notarial\u0103 a contractelor se efectueaz\u0103 la locul amplas\u0103rii parcelei de teren sau la locul \u00eenregistr\u0103rii uneia dintre p\u0103r\u021bi.<\/p>\n\n<p>La alegerea notarului, merit\u0103 s\u0103 lua\u021bi \u00een considerare:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>experien\u021ba \u00een \u00eenregistrarea contractelor cu bunuri imobile, \u00een special terenuri agricole;<\/li>\n\n\n\n<li>recenziile despre munc\u0103;<\/li>\n\n\n\n<li>comoditatea amplas\u0103rii biroului.<\/li>\n<\/ul>\n\n<p>Costul serviciilor notarului se compune din:<\/p>\n\n<ol class=\"wp-block-list\">\n<li>Taxa de stat \u2014 1% din valoarea contractului.<\/li>\n\n\n\n<li>Plata pentru servicii suplimentare de natur\u0103 juridic\u0103.<\/li>\n\n\n\n<li>Asigurarea tehnic\u0103.<\/li>\n<\/ol>\n\n<p>Costul total al serviciilor notarului poate fi de la 3.000 la 10.000 de grivne, \u00een func\u021bie de pre\u021bul parcelei \u0219i regiunea.<\/p>\n\n<p>Cum s\u0103 vinzi terenul corect \u0219i \u00een siguran\u021b\u0103? Este necesar s\u0103 alege\u021bi un notar experimentat care se specializeaz\u0103 \u00een chestiuni funciare. Acest lucru garanteaz\u0103 efectuarea corect\u0103 a verific\u0103rilor \u0219i va ajuta s\u0103 evita\u021bi problemele \u00een viitor.  <\/p>\n\n<p>Pentru cei care se \u00eentreab\u0103 cum s\u0103 cumpere teren agricol, este important s\u0103 \u0219tie c\u0103 notarul \u00eenainte de autentificarea contractului va verifica nu doar documentele, ci \u0219i conformitatea cump\u0103r\u0103torului cu cerin\u021bele legisla\u021biei privind posibilitatea dob\u00e2ndirii dreptului de proprietate.<\/p>\n\n<h3 class=\"wp-block-heading\">Particularit\u0103\u021bile evalu\u0103rii terenului<\/h3>\n\n<p>Exist\u0103 dou\u0103 tipuri principale de evaluare a terenului:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>evaluarea monetar\u0103 normativ\u0103 (EMN) \u2014 se stabile\u0219te conform metodologiei Cabinetului de Mini\u0219tri al Ucrainei \u021bin\u00e2nd cont de caracteristicile solului, amplasarea parcelei \u0219i al\u021bi factori;<\/li>\n\n\n\n<li>evaluarea monetar\u0103 expert\u0103 \u2014 se efectueaz\u0103 de c\u0103tre evaluator pe baza valorii de pia\u021b\u0103 a terenului.<\/li>\n<\/ul>\n\n<p>Cum s\u0103 vinzi rapid terenul cu beneficiul maxim? Conform legisla\u021biei, p\u00e2n\u0103 la 1 ianuarie 2030 pre\u021bul parcelelor agricole, delimitate \u00een natur\u0103 proprietarilor de cote, nu poate fi mai mic dec\u00e2t evaluarea lor monetar\u0103 normativ\u0103. <\/p>\n\n<p>Pentru determinarea valorii reale de pia\u021b\u0103 se recomand\u0103 comandarea unei evalu\u0103ri experte chiar \u0219i \u00een cazurile c\u00e2nd legea nu o cere. Cu toate acestea, exist\u0103 anumite restric\u021bii \u0219i cerin\u021be pentru cump\u0103rarea-v\u00e2nzarea. <\/p>\n\n<p>Conform legisla\u021biei, pot dob\u00e2ndi dreptul de proprietate:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>cet\u0103\u021benii Ucrainei;<\/li>\n\n\n\n<li>persoanele juridice din Ucraina, create \u0219i \u00eenregistrate conform legisla\u021biei Ucrainei, ai c\u0103ror participan\u021bi sunt doar cet\u0103\u021beni ai Ucrainei, statul sau comunit\u0103\u021bile teritoriale;<\/li>\n\n\n\n<li>comunit\u0103\u021bile teritoriale;<\/li>\n\n\n\n<li>statul.<\/li>\n<\/ul>\n\n<p>Str\u0103inilor le este interzis s\u0103 cumpere terenuri agricole p\u00e2n\u0103 la organizarea unui referendum. De asemenea, exist\u0103 categorii de persoane c\u0103rora le este categoric interzis s\u0103 dob\u00e2ndeasc\u0103 dreptul de proprietate asupra acestor terenuri, \u00een special: <\/p>\n\n<ol class=\"wp-block-list\">\n<li>Persoanele juridice ai c\u0103ror beneficiari sunt cet\u0103\u021beni ai statului agresor.<\/li>\n\n\n\n<li>Persoanele care apar\u021bin organiza\u021biilor teroriste.<\/li>\n\n\n\n<li>Persoanele juridice cu state str\u0103ine \u00een componen\u021ba participan\u021bilor.<\/li>\n\n\n\n<li>Persoanele juridice \u00eenregistrate \u00een zone offshore.<\/li>\n<\/ol>\n\n<p>Cum s\u0103 vinzi teren agricol conform legisla\u021biei? \u00cenainte de \u00eencheierea contractului, notarul este obligat s\u0103 verifice conformitatea dob\u00e2nditorului cu cerin\u021bele stabilite, inclusiv privind dimensiunile limit\u0103 ale parcelelor care pot fi \u00een proprietatea unei persoane (suprafa\u021ba total\u0103 nu poate dep\u0103\u0219i 10.000 de hectare). <\/p>\n\n<h3 class=\"wp-block-heading\">Destina\u021bia terenului care se vinde<\/h3>\n\n<p>Terenurile agricole au particularit\u0103\u021bile \u0219i restric\u021biile lor privind utilizarea.<\/p>\n\n<p>Acestor parcele le apar\u021bin:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>terenurile agricole (arabil, planta\u021bii perene, f\u00e2ne\u021be, p\u0103\u0219uni, p\u00e2rloage);<\/li>\n\n\n\n<li>terenurile neagricole (drumuri \u0219i trec\u0103tori, f\u00e2\u0219ii forestiere de protec\u021bie \u0219i alte planta\u021bii similare, terenuri sub cl\u0103diri gospod\u0103re\u0219ti \u0219i cur\u021bi, terenuri de conservare temporar\u0103 etc.).<\/li>\n<\/ul>\n\n<p>\u00centrebarea dac\u0103 se poate vinde o cot\u0103 \u0219i schimba destina\u021bia ei \u00eei preocup\u0103 pe mul\u021bi proprietari de teren. Dup\u0103 achizi\u021bionarea parcelei, noul proprietar \u00eentr-adev\u0103r are dreptul s\u0103 ini\u021bieze schimbarea destina\u021biei acesteia, \u00eens\u0103 acest lucru necesit\u0103 respectarea strict\u0103 a procedurilor stabilite de legisla\u021bie. <\/p>\n\n<p>Dac\u0103 v\u0103 intereseaz\u0103 cum s\u0103 vinzi o parcel\u0103 de teren agricol, este important s\u0103 re\u021bine\u021bi: la \u00eencheierea contractului de cump\u0103rare-v\u00e2nzare trebuie s\u0103 indica\u021bi destina\u021bia acesteia conform documentelor existente. Dac\u0103 utilizarea efectiv\u0103 a terenului nu corespunde celei declarate, acest lucru poate duce la amenzi sau alte consecin\u021be juridice. <\/p>\n\n<h3 class=\"wp-block-heading\">Absen\u021ba restric\u021biilor<\/h3>\n\n<p>\u00cenainte de \u00eencheierea contractului de cump\u0103rare-v\u00e2nzare este necesar s\u0103 v\u0103 asigura\u021bi de absen\u021ba oric\u0103ror restric\u021bii care pot \u00eempiedica realizarea tranzac\u021biei.<\/p>\n\n<p>Algoritmul de verificare:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>ob\u021binerea extrasului din Registrul de Stat al Drepturilor Reale asupra Bunurilor Imobile, care con\u021bine informa\u021bii despre sarcini (arest\u0103ri, ipoteci, interdic\u021bii de \u00eenstr\u0103inare);<\/li>\n\n\n\n<li>verificarea datelor din Cadastrul Funciar de Stat pentru existen\u021ba restric\u021biilor \u00een utilizarea parcelei de teren;<\/li>\n\n\n\n<li>verificarea informa\u021biilor \u00een Registrul Unic al Hot\u0103r\u00e2rilor Judec\u0103tore\u0219ti dup\u0103 num\u0103rul cadastral al parcelei de teren pentru existen\u021ba litigiilor judiciare;<\/li>\n\n\n\n<li>ob\u021binerea informa\u021biilor din Registrul de Stat al Sarcinilor Bunurilor Mobile (dac\u0103 pe parcel\u0103 exist\u0103 obiecte imobile);<\/li>\n\n\n\n<li>verificarea existen\u021bei datoriilor la impozitul pe teren.<\/li>\n<\/ul>\n\n<p>Cum s\u0103 vinzi teren \u00een cote f\u0103r\u0103 riscuri? \u00cen primul r\u00e2nd este necesar s\u0103 v\u0103 asigura\u021bi c\u0103 parcela nu se afl\u0103 sub interdic\u021bia de \u00eenstr\u0103inare. Aten\u021bie special\u0103 trebuie acordat\u0103 faptului c\u0103, conform legisla\u021biei, cotele situate pe teritoriile temporar ocupate pot fi doar transmise prin mo\u0219tenire.  <\/p>\n\n<h2 class=\"wp-block-heading\">Se poate vinde o cot\u0103 de teren dac\u0103 este \u00een \u00eenchiriere<\/h2>\n\n<p>R\u0103spunsul la aceast\u0103 \u00eentrebare este pozitiv, dar \u021bin\u00e2nd cont de particularit\u0103\u021bile stabilite de legisla\u021bie.<\/p>\n\n<p>Etapele principale, cum s\u0103 vinzi o cot\u0103 de teren dac\u0103 este \u00een \u00eenchiriere:<\/p>\n\n<ol class=\"wp-block-list\">\n<li>Proprietarul trebuie s\u0103 anun\u021be \u00een scris locatarul despre inten\u021bia de a vinde parcela cu indicarea pre\u021bului \u0219i a altor condi\u021bii de v\u00e2nzare.<\/li>\n\n\n\n<li>Notificarea se trimite prin scrisoare recomandat\u0103 cu descrierea con\u021binutului sau se \u00eenm\u00e2neaz\u0103 personal sub semn\u0103tur\u0103.<\/li>\n\n\n\n<li>Locatarul are 30 de zile de la momentul primirii notific\u0103rii pentru a lua decizia de cump\u0103rare.<\/li>\n\n\n\n<li>Dac\u0103 locatarul refuz\u0103 dreptul de preemp\u021biune sau nu ofer\u0103 r\u0103spuns \u00een termen de 30 de zile, proprietarul poate vinde parcela altei persoane la un pre\u021b nu mai mic dec\u00e2t cel propus.<\/li>\n<\/ol>\n\n<p>R\u0103scump\u0103rarea parcelei de teren care se afl\u0103 \u00een \u00eenchiriere poate fi efectuat\u0103 cu acordul p\u0103r\u021bilor chiar \u0219i \u00eenainte de expirarea termenului contractului de \u00eenchiriere. \u00cen acest caz, contractul \u00eenceteaz\u0103 din momentul trecerii dreptului de proprietate la locatar. <\/p>\n\n<h2 class=\"wp-block-heading\">Impozitele la cump\u0103rarea-v\u00e2nzarea de teren agricol<\/h2>\n\n<p>V\u00e2nz\u0103torul pl\u0103te\u0219te impozitul pe veniturile din v\u00e2nzarea parcelei de teren.
