Acest articol va fi util proprietarilor de cote care doresc s\u0103-\u0219i gestioneze partea lor: s\u0103 o v\u00e2nd\u0103, s\u0103 o doneze, s\u0103 o dea \u00een arend\u0103 sau s\u0103 o transmit\u0103 mo\u0219tenire. Vom analiza \u00een detaliu c\u00e2t cost\u0103 s\u0103 transferi o cot\u0103 de teren \u0219i cum s\u0103 faci acest lucru corect \u0219i legal.  <\/p>\n\n<h2 class=\"wp-block-heading\">Cine are dreptul la o cot\u0103 de teren<\/h2>\n\n<p>Dup\u0103 ce am stabilit ce este o cot\u0103 de teren, merit\u0103 s\u0103 afl\u0103m despre de\u021bin\u0103torii de drepturi. Dreptul la o cot\u0103 de teren \u00eel au fo\u0219tii membri ai KSP, care au fost inclu\u0219i \u00een lista anexat\u0103 la actul de stat privind dreptul de proprietate colectiv\u0103 asupra terenului, conform Codului Funciar al Ucrainei (<a href=\"https:\/\/zakon.rada.gov.ua\/laws\/show\/2768-14#Text\">art. 1<\/a>) \u0219i Decretului Pre\u0219edintelui Ucrainei \u201eCu privire la procedura de \u00eemp\u0103r\u021bire a terenurilor transferate \u00een proprietate colectiv\u0103 \u00eentreprinderilor \u0219i organiza\u021biilor agricole\u201d (<a href=\"https:\/\/zakon.rada.gov.ua\/laws\/show\/720\/95#Text\">pct. 2<\/a>). Cei care au dreptul la o cot\u0103 de teren includ:  <\/p>\n\n<ul class=\"wp-block-list\">\n<li>angaja\u021bii CAP;<\/li>\n\n\n\n<li>pensionarii care au lucrat anterior \u00een CAP;<\/li>\n\n\n\n<li>mo\u0219tenitorii dreptului la cota de teren.<\/li>\n<\/ul>\n\n<p>Dreptul la cot\u0103 nu depinde de vechimea \u00een munc\u0103, de indicatorii de produc\u021bie sau de locul de re\u0219edin\u021b\u0103. Chiar dac\u0103 o persoan\u0103 nu mai lucreaz\u0103 la CAP sau s-a mutat, \u00ee\u0219i p\u0103streaz\u0103 dreptul. <\/p>\n\n<h3 class=\"wp-block-heading\">Documente pentru cota de teren<\/h3>\n\n<p>Documentele principale pentru cota de teren sunt:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>certificatul pentru dreptul la cota de teren;<\/li>\n\n\n\n<li>actul de stat pentru dreptul de proprietate asupra terenului;<\/li>\n\n\n\n<li>certificatul de mo\u0219tenire;<\/li>\n\n\n\n<li>contractul de v\u00e2nzare-cump\u0103rare, dona\u021bie, schimb al cotei de teren.<\/li>\n<\/ul>\n\n<p>Cum s\u0103 ob\u021bine\u021bi o cot\u0103 de teren? Trebuie s\u0103 v\u0103 adresa\u021bi administra\u021biei locale cu o cerere corespunz\u0103toare \u0219i un pachet de documente. <\/p>\n\n<p><em>Citi\u021bi \u0219i: <\/em><a href=\"https:\/\/weagro.ua\/blog\/kvalifikovanyj-elektronnyj-pidpys-kep-shho-cze-ta-yak-otrymaty\/\"><em>Semn\u0103tura electronic\u0103 calificat\u0103 (SEC): ce este \u0219i cum s\u0103 o ob\u021bine\u021bi<\/em><\/a><\/p>\n\n<h3 class=\"wp-block-heading\">C\u00e2t cost\u0103 s\u0103 \u00eenregistrezi o cot\u0103 de teren<\/h3>\n\n<p>Costul \u00eenregistr\u0103rii unei cote de teren const\u0103 din mai multe pl\u0103\u021bi:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>pentru preg\u0103tirea documenta\u021biei tehnice \u2014 500-2000 grivne;<\/li>\n\n\n\n<li>pentru \u00eenregistrarea \u00een cadastrul funciar \u2014 230 grivne;<\/li>\n\n\n\n<li>pentru \u00eenregistrarea dreptului de proprietate \u2014 230 grivne;<\/li>\n\n\n\n<li>pentru serviciile notariale \u2014 1000-2000 grivne.<\/li>\n<\/ul>\n\n<p>\u00cen total, procedura va costa \u00eentre 2-5 mii grivne. \u00cen ceea ce prive\u0219te c\u00e2t cost\u0103 o cot\u0103 de teren, conform datelor <a href=\"https:\/\/opendatabot.ua\/open\/land\">OpenData Bot<\/a>, pre\u021bul mediu de v\u00e2nzare variaz\u0103 \u00een jurul valorii de 1000$\/ha. Pre\u021bul este influen\u021bat de m\u0103rime, configura\u021bie, loca\u021bie, caracteristicile calitative ale solului \u0219i cererea pie\u021bei. Cele mai scumpe parcele sunt \u00een regiunea Cerkasi, cele mai ieftine \u00een regiunea Jitomir.    <\/p>\n\n<p><em>Citi\u021bi \u0219i: <\/em><a href=\"https:\/\/weagro.ua\/blog\/yak-fermerka-zavdyaky-weagro-zmogly-zavershyty-posivnu-kampaniyu\/\"><em>Cum a reu\u0219it o fermier\u0103 s\u0103-\u0219i finalizeze campania de \u00eens\u0103m\u00e2n\u021bare datorit\u0103 WEAGRO<\/em><\/a><\/p>\n\n<h3 class=\"wp-block-heading\">Cine pl\u0103te\u0219te impozitul pentru cota de teren<\/h3>\n\n<p>Pl\u0103titorul este proprietarul. Rata pentru cei care pl\u0103tesc impozit pentru cota de teren este \u00eentre 0,3% \u0219i 1% din evaluarea monetar\u0103 normativ\u0103, \u00een func\u021bie de loca\u021bie \u0219i destina\u021bia terenului (<a href=\"https:\/\/zakon.rada.gov.ua\/laws\/show\/2755-17#Text\">art. 274 din Codul Fiscal<\/a>). Beneficiaz\u0103 de scutiri la plat\u0103:  <\/p>\n\n<ul class=\"wp-block-list\">\n<li>persoanele cu dizabilit\u0103\u021bi;<\/li>\n\n\n\n<li>participan\u021bii la ATO\/OOS \u0219i membrii familiilor acestora;<\/li>\n\n\n\n<li>proprietarii de terenuri din zonele montane.<\/li>\n<\/ul>\n\n<p>Pl\u0103tesc pensionarii impozit pentru cota de teren? Conform legisla\u021biei \u00een vigoare, nu. Pentru a beneficia de scutire, trebuie s\u0103 depun\u0103 o cerere \u0219i documentele justificative la serviciul fiscal.  <\/p>\n\n<p><em>Citi\u021bi de asemenea: <\/em><a href=\"https:\/\/weagro.ua\/blog\/yak-diznatys-sumu-podatku-na-zemlyu-i-yak-jogo-splatyty\/\"><em>Cum s\u0103 afla\u021bi suma impozitului pe teren \u0219i cum s\u0103-l pl\u0103ti\u021bi<\/em><\/a><\/p>\n\n<h3 class=\"wp-block-heading\">Cum s\u0103 declara\u021bi cota de teren<\/h3>\n\n<p>Deoarece cota de teren este obiect al impozit\u0103rii, aceasta trebuie declarat\u0103. C\u00e2nd \u0219i cum s\u0103 declara\u021bi cota de teren: <\/p>\n\n<ul class=\"wp-block-list\">\n<li>la v\u00e2nzarea cotei \u00een termen de un an de la dob\u00e2ndirea propriet\u0103\u021bii;<\/li>\n\n\n\n<li>dac\u0103 cota este dat\u0103 \u00een arend\u0103 \u0219i se prime\u0219te venit din chirie;<\/li>\n\n\n\n<li>la mo\u0219tenirea cotei sau la donarea acesteia.<\/li>\n<\/ul>\n\n<p>Declara\u021bia se depune la serviciul fiscal de la locul de re\u0219edin\u021b\u0103 p\u00e2n\u0103 la 1 mai al anului urm\u0103tor celui de raportare. Pentru plata cu \u00eent\u00e2rziere a impozitelor sunt prev\u0103zute amenzi. <\/p>\n\n<h2 class=\"wp-block-heading\">Este necesar\u0103 privatizarea cotei de teren<\/h2>\n\n<p>Privatizarea cotei de teren \u00eenseamn\u0103 delimitarea acesteia \u00een natur\u0103 pe teren \u0219i ob\u021binerea actului de stat pentru dreptul de proprietate privat\u0103 \u00een locul certificatului. Este necesar\u0103 privatizarea cotei de teren? Da, acest lucru nu este doar necesar pentru gestionarea deplin\u0103 a terenului: v\u00e2nzare, donare, dare \u00een arend\u0103, mo\u0219tenire. Dac\u0103 nu reu\u0219i\u021bi p\u00e2n\u0103 la 1 ianuarie 2028, terenul va trece \u00een proprietatea comunal\u0103 a comunit\u0103\u021bii teritoriale. Pute\u021bi privatiza cota gratuit, adres\u00e2ndu-v\u0103 cu o cerere la administra\u021bia local\u0103. Proprietarii au posibilitatea de a vinde cota de teren. Pentru aceasta este necesar:  <\/p>\n\n<ol class=\"wp-block-list\">\n<li>S\u0103 privatiza\u021bi terenul \u0219i s\u0103 ob\u021bine\u021bi Actul de Stat pentru dreptul de proprietate.<\/li>\n\n\n\n<li>S\u0103 v\u0103 adresa\u021bi notarului pentru \u00eencheierea contractului de v\u00e2nzare-cump\u0103rare.<\/li>\n\n\n\n<li>S\u0103 preg\u0103ti\u021bi pachetul de documente. Acestea sunt actul de stat pentru teren, extrasul din Cadastrul Funciar de Stat, extrasul din Registrul de Stat al Drepturilor Reale, raportul de evaluare monetar\u0103 expert\u0103 a terenului, documentul privind plata impozitului pe venitul din v\u00e2nzare. <\/li>\n\n\n\n<li>S\u0103 \u00eencheia\u021bi contractul de v\u00e2nzare-cump\u0103rare, s\u0103-l semna\u021bi \u0219i s\u0103-l autentifica\u021bi notarial.<\/li>\n\n\n\n<li>S\u0103 pl\u0103ti\u021bi taxa de stat de 1% \u0219i s\u0103 \u00eenregistra\u021bi contractul.<\/li>\n<\/ol>\n\n<p>Dup\u0103 \u00eenregistrarea contractului, cump\u0103r\u0103torul devine proprietarul deplin al terenului, iar v\u00e2nz\u0103torul prime\u0219te banii. \u00cen ceea ce prive\u0219te posibilitatea de a vinde cota de teren \u00een timpul r\u0103zboiului, acest lucru nu este interzis. <\/p>\n\n<h3 class=\"wp-block-heading\">Se poate vinde o cot\u0103 de teren dac\u0103 este \u00een \u00eenchiriere<\/h3>\n\n<p>Mul\u021bi oameni se \u00eentreab\u0103 dac\u0103 pot vinde cota de teren dac\u0103 este \u00een arend\u0103? Da, dar trebuie s\u0103 respecta\u021bi procedura prev\u0103zut\u0103 de legisla\u021bie \u0219i contract. \u00cen special, arenda\u0219ul are drept de preemp\u021biune la cump\u0103rarea cotei. Pentru a vinde cota arendat\u0103 unei alte persoane, este necesar:   <\/p>\n\n<ol class=\"wp-block-list\">\n<li>S\u0103 notifica\u021bi \u00een scris arenda\u0219ul despre inten\u021bia de a vinde cota, specific\u00e2nd pre\u021bul \u0219i alte condi\u021bii de v\u00e2nzare.<\/li>\n\n\n\n<li>S\u0103 acorda\u021bi 1 lun\u0103 pentru luarea deciziei de cump\u0103rare.<\/li>\n\n\n\n<li>Dac\u0103 arenda\u0219ul a refuzat sau nu a r\u0103spuns, pute\u021bi \u00eencheia contractul cu alt cump\u0103r\u0103tor.<\/li>\n\n\n\n<li>Noul proprietar al cotei devine arendator pentru perioada r\u0103mas\u0103.<\/li>\n<\/ol>\n\n<p>Restul procedurii de v\u00e2nzare a cotei de teren este aceea\u0219i ca \u0219i pentru cotele nearendate.<\/p>\n\n<p>Legisla\u021bia stabile\u0219te competen\u021bele arenda\u0219ului cu privire la cotele luate \u00een arend\u0103. Acesta are dreptul: <\/p>\n\n<ul class=\"wp-block-list\">\n<li>s\u0103 schimbe terenurile arendate;<\/li>\n\n\n\n<li>s\u0103 dea cotele arendate \u00een subarend\u0103;<\/li>\n\n\n\n<li>s\u0103 aduc\u0103 dreptul de arend\u0103 ca aport la capitalul social al \u00eentreprinderilor;<\/li>\n\n\n\n<li>s\u0103 transfere drepturile \u0219i obliga\u021biile din contractul de arend\u0103 unei alte persoane.<\/li>\n<\/ul>\n\n<p>\u00cen acest caz, toate drepturile \u0219i obliga\u021biile privind cota trec la noul arenda\u0219, iar contractul r\u0103m\u00e2ne \u00een vigoare \u00een condi\u021biile anterioare.<\/p>\n\n<p><em>Pentru utilizarea eficient\u0103 a terenurilor agricole, fermierii au nevoie de resurse materiale \u0219i tehnice &#8211; semin\u021be, \u00eengr\u0103\u0219\u0103minte, produse de protec\u021bie a plantelor. Suprafa\u021ba maxim\u0103 \u00eentr-o singur\u0103 m\u00e2n\u0103 nu putea dep\u0103\u0219i 100 ha. Persoanele juridice au dreptul s\u0103 cumpere teren din 2024 \u00een volum de p\u00e2n\u0103 la 10 mii ha. Este interzis\u0103 achizi\u021bionarea de cote de c\u0103tre str\u0103ini, apatrizi \u0219i persoane juridice cu capital str\u0103in de peste 50%. Cump\u0103r\u0103torii tipici sunt:     <\/p>\n\n<ul class=\"wp-block-list\">\n<li>fermieri \u0219i companii agricole pentru extinderea afacerii;<\/li>\n\n\n\n<li>investitori care investesc \u00een terenuri;<\/li>\n\n\n\n<li>comunit\u0103\u021bi teritoriale pentru necesit\u0103\u021bi publice.<\/li>\n<\/ul>\n\n<p>\u00cenainte de a afla dac\u0103 pute\u021bi vinde cota de teren, ar trebui s\u0103 analiza\u021bi pia\u021ba \u0219i s\u0103 determina\u021bi pre\u021bul optim.<\/p>\n\n<h2 class=\"wp-block-heading\">Cum s\u0103 transfera\u021bi cota de teren<\/h2>\n\n<p>Dac\u0103 proprietarul cotei de teren dore\u0219te s\u0103 o transfere gratuit unei alte persoane, poate s\u0103 o doneze sau s\u0103 o lase mo\u0219tenire. Acest lucru permite p\u0103strarea terenului \u00een proprietatea familiei sau a comunit\u0103\u021bii. Pentru a dona cota, se \u00eencheie un contract de dona\u021bie, iar pentru a o l\u0103sa mo\u0219tenire &#8211; se \u00eentocme\u0219te un testament. Ambele documente necesit\u0103 autentificare notarial\u0103 obligatorie. S\u0103 analiz\u0103m aceste modalit\u0103\u021bi \u00een detaliu.    <\/p>\n\n<h3 class=\"wp-block-heading\">Se poate dona cota de teren<\/h3>\n\n<p>La \u00eentrebarea dac\u0103 se poate dona cota de teren, r\u0103spunsul este: da. Forma de proprietate nu conteaz\u0103: poate fi at\u00e2t privat\u0103, c\u00e2t \u0219i de stat sau comunal\u0103. Contractul de dona\u021bie a cotei trebuie s\u0103 con\u021bin\u0103 urm\u0103toarele date:  <\/p>\n\n<ul class=\"wp-block-list\">\n<li>num\u0103rul cadastral, loca\u021bia, suprafa\u021ba \u0219i destina\u021bia terenului;<\/li>\n\n\n\n<li>informa\u021bii despre absen\u021ba restric\u021biilor privind \u00eenstr\u0103inarea cotei;<\/li>\n\n\n\n<li>documentul care confirm\u0103 dreptul de proprietate al donatorului asupra cotei.<\/li>\n<\/ul>\n\n<p>Notarul verific\u0103 aceste informa\u021bii \u0219i autentific\u0103 contractul. Noul proprietar al cotei prime\u0219te un extras din Registrul drepturilor reale. Nu se pl\u0103te\u0219te impozit pe venit la donarea cotei, dar exist\u0103 un impozit pe dona\u021bie de 5% (0% pentru gradele 1-2 de rudenie).  <\/p>\n\n<h3 class=\"wp-block-heading\">Cum s\u0103 transfera\u021bi cota de teren fiului sau fiicei<\/h3>\n\n<p>Cel mai simplu mod de a transfera cota de teren fiului sau fiicei este s\u0103 o dona\u021bi \u00een timpul vie\u021bii sau s\u0103 o l\u0103sa\u021bi mo\u0219tenire. P\u0103rin\u021bii \u00eencheie un contract de dona\u021bie cu copiii lor, iar \u00een cazul mo\u0219tenirii &#8211; \u00eentocmesc un testament \u00een favoarea acestora. Dac\u0103 nu exist\u0103 testament, copiii mo\u0219tenesc cota \u00een condi\u021bii generale ca mo\u0219tenitori de primul rang. Algoritmul de transfer al cotei de teren este urm\u0103torul:   <\/p>\n\n<ol class=\"wp-block-list\">\n<li>Ob\u021bine\u021bi certificatul de mo\u0219tenitor de la notar.<\/li>\n\n\n\n<li>\u00cenregistra\u021bi dreptul de proprietate asupra cotei de teren \u00een Registrul drepturilor reale.<\/li>\n\n\n\n<li>Comanda\u021bi emiterea unui nou Act de Stat pe numele dumneavoastr\u0103.<\/li>\n<\/ol>\n\n<p>Donarea \u0219i mo\u0219tenirea cotei sunt scutite de impozitul pe venit.
